私が情報公開請求をして得た、いきいきプラザの平成２９年度の収支実績によると利益は２３８万３，４０４円となっております。又、健康課からの回答ではプール教室の生徒は約４００名との事で、月謝が１名あたり３，４５６円ですので、年間の売り上げは約１，６５８万８，８００円となります。その他に

空手教室　　５０名で　２３３万２，８００円

体操教室　　３５名で　１６３万２，９６０円

ヒップホップ教室　　１２５名で　５８３万２，０００円

これら４教室の売上合計は２，６３８万６，５６０円となります。

これらの売上及び利益がどこに計上され、どのような決算になっているのか全く分かりません。

これらの４教室以外にもカルチャー教室が６教室、セラピールーム貸し出し等もありますが、これらの売上を調べることは出来ませんでした。このように町民からの税金を原資としている指定管理料及び指定管理者による自主事業の収支決算報告が不明瞭なまま何年間も続いていること自体、不可解この上ないのではないでしょうか。「いきいきプラザの自主事業の収支決算書はありません。」との行政の所管課の回答でしたので、私は自分なりにアバウトではありますが、情報公開請求をし、調べ上げた上で一般質問をしました。明確にして頂きたいと思って計算した内容は下記の通りです。

平成２９年度

町からの年間の指定管理料　　３億１３９万７，２７８円　（町税です）

人件費を含む経費合計　　　　２億９，９０１万３，８７４円

利益　　　　　　　　　　　　２，８７６万４，９６４円

町からの収支実績は２３８万３，４０４円　でした。

差額　２，６３８万１，５６０円はどこにいったのでしょうか。

さらに他の行政では、指定管理者による自主事業の原資が税金であるという事をふまえ、誰が見ても分かる明確な決算書が提出されています。町民の方で私と同じ考えの方がおりましたら、町に行って聞いていただきたいと思いブログに掲載いたしました。

 

 

中心拠点整備事業として構築した「いきいきプラザ」に関する町行政の税金の使い方に問題点が多々あるとして、その問題点を指摘します。
　そもそも「いきいきプラザ」は指定管理者による委託業務として位置づけられているのは周知のことです。それでは町行政は委託業務というものに対し、どのようなスタンスで臨んでいるのでしょうか？
　業務委託とは、その業務に関する全てを委託し、その対価を支払うという事が基本原則であると思います。言い換えれば、営業・メンテナンス・光熱費・人件費等「いきいきプラザ」に関する全ての行為は、指定管理者が行えば良いのではないでしょうか？
　そしてその費用も指定管理者が負担すれば面倒くさい問題は起きません。会計年度ごとに指定管理者に収支報告書を提出させ、その数字を元に翌年度の委託料を決定すれば良いのです。
　その代わりに町が建物本体等の経年劣化による修繕等を負担すれば良いのではないでしょうか。
　収支報告書が適正かどうかは、有識者等を加えた第三者機関と行政責任者が合意の上、毎年確認をすれば、適正な業務委託料を払えることとなります。つまり、すべて売り上げを一旦指定管理者の収入とすればよいのです。
情報公開の提示・請求についても疑義があります。
　私は、指定管理業者及び上三川町行政に対し、情報公開請求をしましたが、概ね個人情報保護に抵触するということで、満足な情報の提示を受けることはできませんでした。
　しかし、私は条例に定められた議会の一員であり、ある意味実施機関サイドの人間でもあるわけです。従って職務として、指定管理業者の業務内容、決算のいきさつ、そして町行政の収支決算等、当然に知らなければならない立場にあるのではありませんか。それらを知ることが町民から付託を受けた私の義務であり、責務と捉えております。ですから、私には実施機関の一員として「いきいきプラザ」の詳細を町民に知らせる義務があるのです。

　実施機関としての議会とは、どういう位置づけなのでしょうか。議会を構成する個々の議員のことをどのように捉えているのでしょう。実施機関としての議会の意味を知っているなら、上三川町情報公開条例の第２条の実施機関の中の最後に議会とありますが、これをなんと考えるかです。

「いきいきプラザ」の構築に借入金２８億４千万円を含めて、総額５５億６千万円の税金を投じ、更に指定管理者に対し年間２億１千万円ほどを支払い、運営しているのが今の状況です。これだけのお金を投じて、町民の中のどれだけの人々が健康で元気に暮せ、長寿の源となっているとお思いですか。
　例えば、他市町に比べ、平均寿命が伸びているとか、高齢者の生存率が上昇しているとか、そのようなデータはあるのですか。
　行政は、ただ漫然と業務委託料を毎年支払い続けることに、何の疑問も持たないのですか。
　さらに経年劣化と異なる費用だと思われる９２４万円の修繕費と称するものに対しての支払いにも何の疑問も持たないのでしょうか。この修繕費の内容を問いただしても具体的な内容は公開されず、不都合極まりないことです。
　私の知りうる範囲でありますが、指定管理料が約２億１千万円、自主事業の売上が約１億７千万円の合計約３億８千万円が指定管理者の収入になるのではありませんか。さらに、その他にも見込まれている収入があるのではないかと想定されるのです。
　このように指定管理者に莫大な利益を与え、これに対し、何の制限も出来ないのであれば、これではまさしく「軒先貸して母屋取られる」ではありませんか。
　このようなことがあるのならば、これこそが癒着の温床になるのではないでしょうか。行政側の誰かがキックバックをもらっていたなどと想定をしないと、つじつまが合わないのです。議会において私がそこを指摘したら、町長から名誉棄損にあたると言われました。そういうことなら、訴訟をして下さい。それなりの決着をつけたいと私は思っています。
いろいろと情報を公開するように要求しても行政側はノウハウの侵害になるということを理由に、かたくなに情報公開を拒否しつづけています。
　それではノウハウとは一体何なのでしょうか。ノウハウとは物事の方法や手順に関する知識であり、技術であります。私は数字の流れを聞いているのですから、それはノウハウとは何の関りもないのではありませんか。それなのに健康課長は、「それも含めてノウハウだ」というような答え方をしています。健康課長が答えた趣旨を、後日、具体的に説明いただきたいと思っております。
　情報開示の拒否理由として、漠然とした個人及び法人情報の保護を掲げることは、権利の濫用になるではないですか。
　個人・法人情報の定義に関しましては、有識者や町民にも意見を求めます。
　税金で５５億６千万で作り上げ、借金を２８億４千万して、平成２９年度の借金残高は、１８億４千３百万がこれから１０年かけて返済して行くようです。年間２憶１千万の委託料を税金で毎年払い続け、アバウトですが、年間の売上合計３億３千９百万以上の売上を計上し、利益は年間で、２百３８万しかないと言う始末です。この決算書すら町は、持っていないと言いますが、では、どなたがこの決算は正しいと言えるのでしょうか。
まして、議員が聞いてもノウハウなので、情報公開して下さいとの返答ばかりです。
上三川町情報公開条例の第二条に実施機関とは、町長、教育委員会、選挙管理委員会、監査委員、農業委員会、固定資産評価案委員会、水道事業及び議会と有るが、実施機関に議会が入っているという事は、議員も実施機関の一員と言う事になると思いますが、このブログを見て頂いた町民及び一般の方々のご意見が伺いたいと思って書いております。

上三川の行政は議員が議会で質疑応答した諸問題に、一向に対処していません。
町民の付託を受けた議員に対し、不届きではありませんか。
　そもそも行政と議会は国における内閣と国会の関係と同じです。常に対等でなければならないのです。それにもかかわらず本上三川町では、議会は行政の言うがままです。これでは町民の付託に応えていることにはなりません。行政側が作成した施策案に、何ら疑いもせず、詮索もせず、自らの考えなど全くなく、もろ手を挙げて賛成する議員など、町民は見たくもないでしょう。まさしく町民不在の議会となってしまうのです。行政側の施策案に対し、賛成するも反対するも理由を付さなければならないと思います。議会において一般質問の中の質疑応答で執行部が「よく検討します。精査します。調査します。研究します。」と保留した問題に関しては次回の議会において、問題の経過なり、解決案なり、それらの結果を必ず回答するこということにしては如何ですか。とにかく一つの問題をいつまでも放置しないということです。必ず実行することを是非お約束してください。議会は行政の暴走を止めなければならない義務があるのです。議会が行政の抑止力とならなければ、上三川町政は円滑に進みません。それには議員一人一人が自覚を持ち、一定の教養と見識がなければなりません。又、議員間でも新人議員が古参の議員に遠慮するとか、気を配るとか、普段の礼儀、礼節は守るべきですが、議論の場ではそのような忖度は無用なのです。議論の場では、新人も古参も対等でなければなりません。
　それから行政側あるいは多数派議員の中には、特定の議員の意見、施策案だけは良い悪いに関わらず絶対に取り上げたくないというような風潮もあります。もしこのようなことがあれば上三川町の町政は地に落ち、その場で崩壊することとなるでしょう。まさしく町民不在の政治となり、この町は闇に包まれることになります。例え、憎らしいやつであっても、いいものはいいのです。行政側にとって耳の痛いこともあるでしょう。しかしすべての意見、施策案等は充分に検討し、そのうえで判断しなければ、いつまでたっても上三川町の進歩は望めません。
　町議会員の好き嫌いは町のためにはなりません。巷ではそういうことが話題になっていますよ。政治を人の好き嫌いとか派閥の馴れ合いとかで動かされては、町民にとってはたまったものではありません。誰が何と云おうと一番大切なことは町民の幸福であり、町民の利益です。これに沿った行政、そして議会運営を実行していかなければならないということを自覚してください。
　予算に関しても代り映えせず、例年の継続という形で構成されているだけで何の進展性も見られません。予算の取り方がマンネリ化しているのではないかと思います。町長以下、上層部はそのように指導しているのでしょうか。上三川町独特の処世術、「何もするな、何も言うな、そうすれば黙って課長の椅子がついてくる。」を粛々と実行する。これがこの町に浸透しているからこそ、こんな予算編成になるのでしょう。予算書は町民や議員に対しての作文以外の何のものでもなく、実行した形跡もうかがえず絵に描いた餅になりつつありと考えます。前年と比較して、補正予算でも述べましたが３０年度予算でも何が変わったか見たところ、増額が９項目、減額が２０項目、同額が２６項目でした。
　これは町長の所信表明の内容が変わっただけとしか私は思えず、職員のレベルの低さを感じずにはいられません。予算がマンネリ化した編成の中に押し込まれていたのでは、何かチャンスがあったときに踏み込んでは行けません。
　大企業の日産にしても未来永劫この上三川町で操業する約束がある訳でもなく、いつ撤退するかわかりません。執行部やそこを取り巻く議員たちは少なからずそのような危機意識をもっているのでしょうか。私はこのような悪い意味でのマンネリ化した変革性のない今年度の予算編成に対し、断固反対し、実行可能な予算編成を要望する所存です。以上のことから私はこの陳述を以って反対討論と致します。

私は２８年一般会計決算執行に反対致します。
その理由は、町民本位ではなく、行政の都合の良い予算執行をしているからです。
度々、一般質問で申し上げている都市計画税により、利益を受ける受益者の度合いの差があるのに徴収し、町民に不平等が生じているのに見直しもせず、一般会計補正で積立金と称し、町税収入の１割に相当する積立金１２億６８百万も金額を積立し、その積立金残高は、４３億円以上あり、２８年度の都市計画税は２億１千８００万以上の税収入があるにも関わらず、都市計画税を納めている町民に何を持って受益者がどのような利益を受けているか、明示もないでしょう。
その理由は税収の予算に対し、積立金の取り崩しを持って予算計上をしているからであり、予算とは全て計上の上で作り上げるべきで、作り上げる能力の無さが見え隠れしているからだと私は思っているので、そのような職員が、集中制作プラン２８年度の実施状況などを見ると、２４区分でＡが２３、Ｂが１２、Ｃが２等とすべて行政の手盛りの何物でもない。側溝清掃などは、私の知りえる所では、議員になり日より毎年の如く道路維持費として、１億からの予算を組み、側溝清掃などは、年間５０万の予算は４５０ｍ、１，７７８，９７６円が、３年間でやったのです。現在の側溝の延長は９７ｋｍもあり、都市計画課の計算では、年間３００万の事業費で清掃が終わるには、１４５年もかかると言う始末です。
これでは、側溝が１５０年も現在のままあると思って計算しているのでしょうか。側溝の清掃など５０年以上、修繕以外にやっていないのです。そのような状態なのに雨水事業を都市計画税によって賄い、事業を遂行しようとしていることが理解できません。事前の清掃修繕の段階を通り越して、平気で計画を立てる行政の考え方や姿勢などあってはならないことだと思います。このようなずさんな補正予算の執行に断固反対致します。

２８年度の予算に対して反対いたします。
その根拠は、いきいきプラザ管理料が年間210,549千円あり、年間の利用料金、その他で86,135,156円収入があり、これで利益が27,802円とありますが、これでは上三川町の予算書と同じではありません。人件費、外注費、経費の項目が知らされなくては、何を根拠に算出しているのか理解できません。また、町民のために使用するパソコン、サーバー、器具などの委託料、使用料だと、使用する賃借料は１９年度が195,480千円、２０年度203,436千円、２１年度226,668千円、２２年度189,987千円、２３年度184,258千円とあり、５年間も使用して、すこしも少なくなっていないのが実状です。今年度は合計282,619千円という高額で一番多く、２０年度と比べてみると79,183千円も多い金額で、一町民が一生働いても稼ぐことのできない金額であります。これは経費の垂れ流しと同じではないかと思うからです。あなた方は町民の税金で賄っている行政マンです。少しでも経費を抑えて無駄のない行政であるべき、と考えて私は今年度の予算に反対し、現実性のある予算を組むべきだと考えております。
その手始めとして、いきいきプラザの業務委託料についての見直しを提議します。現在の委託料が適正かどうかを判定しなければなりません。そもそも、支出するための予算は各年度毎に入念に精査し、決定すべきです。いきいきプラザの業務委託料、および営業収入は当然、毎年数字も内容が違います。
それによって、支出も変わってくるのは当然の事ですし、決して一律ではありません。支出は各項目別に金額を算出し、それが適正であるかどうかを見極めることから始めなければなりません。他の自治体は、そうした契約をしています。それが当たり前ではないのでしょうか。そして、その年度毎に検討し委託料を決定しなければなりません。経営内容により、赤字であれば委託料を増やさなければなりませんし、黒字であれば委託料を削減(さくげん)するということになりますが、どうして職員の方は理解していないのですか。そうなれば、支出項目を明確にして、最終的には町民の判断を仰がなければなりません。判断するには収支報告書を町民に公開しなければならないのは、当たり前のことではありませんか。それを、営業上のノウハウの侵害とか、個人情報の漏洩(ろうえい)とか、誰の立場でものを言っているのですか。
大切にしなければならないのは、委託業者ではなくて、町民ではないのですか。いきいきプラザやパソコン、サーバー、器具等の委託料も同じです。
町民の税負担で運営しているのだと言うことを肝に銘じて下さい。優先順位はあくまでも、町民の利害なのです。
支出項目の明細が分からなければ、お金の使い道が全く不明瞭になるだけです。行政側には、チェック機能を果たす優秀な職員はいないのですか。委託業務とは、何もかも全てを任せる、と言うものではありません。大事なことは、町民の支払う税金が無駄に使われないことなのです。

以上、要点をまとめますと、
１．に毎年、年度毎に委託料等、数字を検討し次年度にそれを生かす、ということ
２．保護するのは町民の利益であり、委託業者の利益ではない、ということです。
これら、2点は町民のだれもが納得することではありませんか。すぐに改善して下さい。そして、堂々と情報公開して下さい。これが守らなければ、上三川町における民主政治の崩壊につながります。

我が町、上三川は開かれた行政や情報公開をキャッチフレーズに使いながら、実際の議会運営の体たらくは目に余る思いであります。
３月議会で私は質問をしましたが、すべて回答を得ることができませんでした。
私は上三川行政のあるべき姿を考え、他の議員の良心を疑うのみでした。
特に議長は、公明正大で中立の立場でものを言って欲しかったと思いますし、議会事務局長の行政寄りの発言も目に余るものでした。
議会が民主的に運営されることが、町政の根本であると思います。
上三川町議会は、行政の御用議会と行政の御用議会と成り下がっています。
ある古参議員に至っては、行政を「ヨイショ」する発言ばかり。
これでは、三権分立の名がすたります。
私が議会で質問したかった事をブログに載せますので、読んでみて下さい。

◆全く回答を得られなかった質問◆

【上三川町情報公開条例の解釈・運用について】
●まず上三川町情報公開条例第７条第３号がどういうものか、お伺いします。
その中にこのような文面がありますが、「公(おおやけ)にすることにより、当該法人等又は当該個人の権利、競争上の地位その他正当な利益を害すると認められるもの。」　この条文をどこに当てはめるのでしょうか。
⇒情報公開で異議申立が完了している、とのことで回答なし
●他の市町村も上三川町と同じく日本水泳振興会（上三川町ではいきいきプラザの指定管理業者）に業務委託をしています。他の市町村に上三川町と同じように、情報公開を求めたところ、すべての情報を公開して下さいました。このことについて、どう思いますか。
●「収支決算報告に関する質問」
　①人権費以下、一般管理費の数値が黒塗りになっています。あらかじめ言っておきますが、公開を拒む時は、条例第７条３号を適用する他ないわけです。そのことは認識していますか。
　②今回は第７条第３号の法解釈と適用方法についてお聞きしているのです。何故ならば、上三川町の本件に関する行為は他市町村の対応とまったく相反しています。そのことも含め質問したいと思います。
　③黒塗りの部分は数字が書かれていると思われますが、この数字が公開されると日本水泳振興会が第７条第３号にいう権利の侵害、競争上の地位その他の正当な利益が害されるおそれがあると行政は判断したからなのでしょうか。
　④正当な利益が害されると判断したのならば、どういうことで、誰が利益を害されることになるのか詳しく説明してください。

【コンポスト訴訟問題に係る町の責任】
　（※コンポストとは：生ごみなどの有機性廃棄物からつくる堆肥、または堆肥化手法のこと。）
●町長の副管理者としての責任について、お聞きします。
①前町長、現町長の債務不履行についての責任と損害の減少に努めなかった責任。
②副管理者は、管理者を補佐し、組合の業務が適正に執行されることについて、管理者とともに共同の責任があると思いますが、どうお答えになりますか。
③副管理者といえども廃棄物処理契約にもとづく取引義務の存在を認識　すべきものであり、これにもとづいて、管理をして、取引義務の履行のための具体的意思決定を行うことや予算措置を講ずることなどを行わせて、補佐すべき義務と責任があった。管理者を補佐する責任を尽くさず、組合に債務不履行を惹起させ、また、平成１５年４月以降は、損害を減少させなかったのであるから、過失があり、管理者と連携して組合が蒙った損害を賠償する責任があると思いますが、お答え下さい。
●組合の管理者に対し、合理性も根拠もない和解をしたことにについて重大な過失又は債務不履行責任があるから、これによって生じた組合の損害５１億９，０９２万８，３５５円を管理者及び副管理者に支払を請求べきであると思います。どう答えますか。
●県南との和解についても、平成２６年４月当時の副管理者らは、同様に補佐責任を十分果たさず、管理者をして前記のように問題のある和解に至らしめたのであるから、この点でも、過失があり、管理者と同様に、管理者と連帯して、損害賠償責任があると思いますが、どう思っていますか。
　　⇒コンポスト問題については他機関の管轄のことであり、議会の決議を既にいただいているもので、お答えしかねる、とのこと。

◆十分に納得できる回答を得られなかった質問◆

●指定管理者（町が業務を委託している事業者）への業務委託に関しては、指定管理者に自主事業（指定管理者が管理する施設を活用して、自ら行う事業）を認める行政もあるが、他の市町村では、自主事業まで認めていないところもあります。上三川町は自主事業まで、なぜ認めて委託をしているのですか。この理由について答えて頂けますか。
　　⇒上三川町では認めている、他の行政のことについては回答できない、とのこと。

◆議長より質問内容を変更するよう指示を受け、全く出来なかった質問◆

【上三川町情報公開条例の解釈・運用について】
●「自主事業の収支報告書について」
　①自主事業の収支報告書のことです。ここはすべて真っ黒（黒く塗り潰されている）です。ここでも言いたいことは一緒です。先ほどと同様（収支決算報告に関する質問と同様に）にお答え下さい。
　②日本水泳振興会（いきいきプラザ指定管理業者）の会社全体の決算書を求めているわけではありません。あくまでも町民の税負担によって運営されている部分の内容を聞いているのです。これも先ほどと同様にお答え下さい。
●「自主事業実施概要一覧について」
　①自主事業実施概要一覧の中の内容欄が真っ黒（黒塗り）です。ここには一体何が書かれているのですか。ここを公開すれば、条例第７条第３号のいう権利の侵害、競争上の地位その他の正当な利益が害されるとでも言うのでしょうか。
　②この部分（自主事業実施概要一覧の中の内容）が公開されたからといって、日本水泳振興会が何らかの損害を被るとは思えませんが、行政としては、隠した部分（黒塗りにした部分）の何が正当な利益を侵害するものだと思うのです　か。
　③（自主事業）活動報告の内容、所感、収支報告に関しても今まで質問したことと同様です。非公開理由（なぜ、黒塗りにしたのか）を詳しく説明して下さい。
●今まで質問したことに関し、行政側が明確に答えられなければ、あなた方は上三川町情報公開条例違反となるのではないですか。よく認識してください。
とにかく曖昧に答えず、第７条第３号に基づいて、法的に答えて下さい。
●他市町村に対し、当町と同じく日本水泳振興会と各市町村との事業報告書、委託契約等の情報公開を申請したところ、殆どの市町村は情報を公開しました。もちろん黒塗りになっているところはありません。上三川町は他の市町村が実行していることをすぐ真似する独自性のない町だと聞いています。当然、良いところは真似て大いに結構なことだと思います。それなのに上三川町は都合の悪いところだけ黒塗りにして情報公開を拒否しました。上三川町だけが本件の何かを隠蔽したくて黒塗りにしたと解釈されてもやむを得ないのではないかと疑われても仕方のないことですね。どう思っているのですか。
●行政は個人情報の保護という、名目を持ち出して、指定管理者の既得権を守ってやるという考えなのですか。（情報公開の内容を）黒塗りにしたのは指定管理者の考えだったのですか。それとも町行政の考え方だったのですか。それとも両方の考えだったのですか。三つのうちの一つだと思いますが、どの考え方だったのですか。
●私が求めているものと同じ内容（町が業務委託している指定管理者の収支・決算報告や自主事業活動等、情報公開を求めた内容）を公然と積極的に行政のホームページで公開している自治体も全国的には数多くありますが、そうした自治体は、上三川町が黒塗りで隠蔽した部分を普通に公開しています。ということは、上三川町の考え方としては他自治体は個人情報の漏洩をしているということになるのですね。町長、そういう解釈でよろしいですか。
●私の考えでは、今回、いきいきプラザの情報公開請求に対して情報公開しなかったということは、第７条第３号の条例違反（公開義務違反）ということになると思います。町としては違法行為に対してどういう責任を負うのでしょうか。違法行為をすれば、罰を受けるのは当然なのですから。はっきり町長、お答え下さい。
●今般、いきいきプラザに関する情報公開を福祉課窓口に申し入れた際、情報公開の決定に至るまでの経過と決定内容をどのように判断したのかについて。
　①内容を黒塗りにするということを誰が最終判断したのか、それとも行政側の総意ということですか。
　②窓口から最終決定に至るまでは、その情報公開申請に関する案件を担当した職員は何名いるか分かりませんけど、本件を当然把握していますね。
　③本件を判断するには、それを是か非か、それとも一部是で一部非とするのかは、答えは三つに一つとなるわけですが、これに関与した職員が数名いるとすれば、それぞれの職員に意見もあったはずです。全員がすべて同じ答え、という　のはあまりにも能がなさ過ぎますよね。もし何の検討も議論もなく、本件のように決定したならば、余りにも情けないことだとは思いませんか。このような職員ばかりにした責任は誰にあると思いますか、町長、お答え下さい。
　④具体的に言えば、「何もこんなところを黒塗りにしなくてもいいのではないか」という意見もあったのではないかと推察しますが、どうだったのでしょうか。
　⑤条例第７条第３号を考えれば、前の通り三つの選択肢の中からどれを選択するかは、意見が割れるのは常識的だし、健全であるといえます。しかし、結局は最終責任者の判断で黒塗りになってしまったということになりますが。このよ　うな常識外のことに何と答えるのですか。
●私が言いたいのは結論に至るまでの過程（情報公開の決定に至るまでの経過と決定内容）に問題があるということです。こういう事例があったときは、他市町村ではどのように対処しているか等、調べてみたり、研究したりしているかということです。その結果一つの結論が導き出されるという図式でなければなりません。それが、役所が民主的に運営されているということにもなるのです。どう思うでしょうか。
